Unfortunately, legal malpractice is not uncommon. It can occur during litigation or in a legal transaction in any number of ways. Following are just a few - there are many others:
- Failure to assert a claim
- Failure to advise a client of his or her rights
- Failure to file within the statute of limitations
- Failure to depose a material witness
- Missing a court-ordered deadline
- Conflict of Interest
Your lawyer owes you a duty of care - a duty to handle your case (or transaction) as a reasonably prudent lawyer would do. Just because you got a bad result does not mean that you have a legal malpractice claim. However, if your attorney did make a mistake that resulted in a loss to you, and that mistake would not have been made by a reasonably prudent attorney, you may have a legal malpractice claim.
At Will Ferguson & Associates, our attorneys have extensive experience handling legal malpractice claims in New Mexico. If you have been harmed by another attorney's negligence, we may be able to help you recoup your losses. Call or e-mail us today to schedule your initial consultation. |
